The jury had to decide on the charge and they did. Of course It was not up to the jury to go look for Baby Kate. The police can go look for her remains and bring them back. Then also Phillips can finally be charged with her murder.

While I respectfully acknowledge this forman's comments, they are necessary for him to feel he made the right decision and validate his guilty verdict. I must take issue with the jury not understanding reasonable doubt. How possibly can a jury make a decision of this matter without hearing the interview of the second of two people involved in this incident? As often is the case juries like to solve and piece together information to fit a crime and often things are made up or left out. This case was based on circumstantial evidence and riddled with reasonable doubt. Juries need to stop giving prosecution an open door to a guilty verdict because they don't understand the term reasonable doubt. What is very reasonable is that very likely this mother knows exactly what happened and she has used this opportunity to blame it all on Sean. Why was her interview not taped? I think Sean was presumed guilty from the minute she called 911 and that unfortunately is how our "innocent until proven guilty" law does not work. Untrained citizens do not have the capacity to understand how the prosecutorial game works and are at a huge disadvantage having to figure it out in the courtroom as they go along. The behavior of this mother screams caution and something just does not add up. Anyone could have written the note they found. Maybe phone was turned off b/c crazy Ariel called him a million times a day. Lots of reasonable possibilities in my mind. It all does not add up! So I ask how does a jury find guilt when there are so many caution flags with the mother????

I strongly disagree with your verdict, and I was there for the whole trial, and I understand the jury's task.

Lugnut, are you related to Ariel or good friends. You seem to be rather biased.

I thank all the jururs for all the time and stress they endured in this trail. I am thankful for our sytem and feel that justice was somewhat served to Sean,. I hope kate is found alive but feel that she is not. I hope if she is not that they find a body and can persue murder charges against sean and maybe even arial. Its such a sad story. I am wondering everytime i go by wendys and look at the woods behind there if anyone has searched the woods behind wendys i hope so the right desciaion was made i just wish that something could be charged to ariel as i think she was involved in maybe a small way.

I hope I am never falsely accused of a crime because now I have seen that a person can be convicted of a serious crime without any evidence whatsoever.

Lugnut on May 03, 2012 at 3:44 PM

Linda, I've never met Ariel or her family. I'm not bias. I've just faced reality. I'm not saying I won't feel sad if they find Baby Kate dead but I accept the reality that she is.

Sean knows what he did with the baby, and would rather go to prison than talk. That is the choice he has made. Even if he didn't harm the baby, and gave it to a better home, he would still rather go to prison than tell the truth. Obviously that is something he can live with.

Do you really not think we understood what reasonable doubt is? We are given instruction to what reasonable doubt is, it is hammered into our brains. Mr. Phillips was given a fair trial, at times it was quirky but it was from the mothers side. If you understood how the note was found, the circumstances surrounding Mr. Phillips confinement you would understand that ultimately the only one who could have written the note was Sean. Yes Sean's phone was not pinging any towers and relaying any gpa coordinates but that just means his whereabouts are unknown. The actions of Ariel Courtland weren't our concern. The question about the law that I asked during deliberation were for the event Ariel was involved which was a major issue. The answer was that Mr.Phillips could still be found guilty if she did in fact have involvement in the dissaperence of baby Kate. To call the jury untrained is just horse wash. We had a wide array of people sitting on the jury, many who are professionals in high paying jobs. We were picked out of almost 100 people. We understood the law, we understood the evidence. Everyone has the right to disagree with our decision but twelve of us decided the same verdict not on a whim or on a hunch but on the evidence presented to us. Sean was innocent until we proved him guilty. Many of us including me were a not guilty vote until we went home and slept on it. Disagreeing with our decision without fully knowing all the evidence, holding it in ur hands, looking at it with your eyes is arrogance. I stand by my decision of guilty and the rest of the jury does too.

"I hope I am never falsely accused of a crime because now I have seen that a person can be convicted of a serious crime without any evidence whatsoever" -- Dilbert This is too true, no matter how this jury foreman tries to justify his verdict, it doesn't make sense. His presumptions are based on the disputed fact that Sean drove off with Kate. He states that Ariel's testimony was 'mostly' ignored due to her veracity, but she is the only one among many witnesses who claims they saw Sean with Kate that day, and the statements to her boss earlier. What was criminal in this case was the investigation being so one-sided, just to make sure someone paid a price for this.

Hats off to the jury for considering the merits of the case and not emotions. Some people do not understand that reasonable doubt must be weighed against a preponderance of the evidence. Look it up. I will hold out hope that this community will pull together and keep looking for Kate. She is there somewhere. It appears LE was quite thorough in their search for any "adoptive parents". It was a dead end. Shake the trees and rattle the bushes. He put her somewhere.

Lugnut on May 08, 2012 at 7:12 AM

Yes dianabee, Phillips did put the baby somewhere. It's called a makeshift grave.

Mary on May 08, 2012 at 7:12 AM

I agree with some of you that Ariel has something to hide, however, she wasn't the one on trial. The jury had to decide on Sean's guilt or innocence, and I agree with them. They did their job. Maybe Ariel's side of the story should be looked at again. I understand that she perjured herself under oath (if I'm wrong, I apologize), but if I'm right, isn't there a charge for that?
